1. Acceptance of Terms

By accessing or using SociMint ("the Service"), operated by SociMint ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SociMint is a social media management platform that provides AI-powered content generation, scheduling, publishing, analytics, and team collaboration tools across multiple social media platforms.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use the Service.
  • One person or legal entity per account. Shared accounts are not permitted.
  • You are responsible for all activity that occurs under your account.

4. Subscription Plans & Billing

  • Free plans are available with limited features as described on our pricing page.
  • Paid subscriptions are billed monthly or annually in advance via Stripe.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored until renewal.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws
  • Post or distribute content that is defamatory, obscene, or infringes on third-party rights
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service to send spam or unsolicited messages
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated scripts to access the Service outside of our provided API
  • Resell or redistribute the Service without written permission
  • Circumvent usage limits or abuse free-tier resources

6. Content Ownership

6.1 Your Content

You retain all rights to content you create, upload, or generate through the Service. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service.

6.2 AI-Generated Content

Content generated by our AI tools is yours to use. You are responsible for reviewing AI-generated content before publishing. We make no guarantees about the accuracy, originality, or suitability of AI-generated content. You are solely responsible for ensuring published content complies with applicable laws and platform policies.

6.3 Our Content

The Service, including its design, features, documentation, and branding, is owned by SociMint and protected by intellectual property laws. You may not copy or reproduce any part of the Service.

7. Social Media Platform Integration

  • The Service connects to third-party social media platforms via their APIs.
  • You must comply with each platform's terms of service when using the Service to publish content.
  • We are not responsible for changes to third-party platform APIs, policies, or availability.
  • Platform access may be revoked by the platform at any time without our control.

8. Team & Collaboration

If you use team features, the account owner is responsible for managing team member access and permissions. You are responsible for content published by team members under your account.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, SociMint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless SociMint and its team from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

  • You may close your account at any time from your account settings.
  • We may suspend or terminate your account for violations of these Terms, with notice where practicable.
  • Upon termination, your right to use the Service ceases immediately. Your data will be deleted within 30 days unless retention is required by law.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the platform. Continued use after changes constitutes acceptance. If you disagree with changes, you may close your account.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which SociMint operates, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
